THIS MANUAL IS DESIGNED TO PROVIDE STATE AND LOCAL BAR ASSOCIATIONS WITH SUFFICIENT INFORMATION AND GUIDANCE FOR DEVELOPING AN EFFECTIVE GRIEVANCE PROCEDURE FOR LOCAL CORRECTIONAL FACILITIES.
Abstract
DIVIDED INTO FOUR PARTS, THE MANUAL FIRST DEALS WITH THE PROCESS OF CONVINCING CORRECTIONAL ADMINISTRATORS, THAT THEY NEED A GRIEVANCE PROCEDURE AND THAT THE KIND OF PROCEDURE THEY SHOULD INTRODUCE IS THE ARBITRATION-MODEL PROCEDURE. A GENERAL REVIEW OF THE BENEFITS OF GRIEVANCE PROCEDURES, A LISTING OF THE PARTICULAR ADVANTAGES OF THE ARBITRATION MODEL, AND A CONSIDERATION OF THE PROGRAMMATIC AND MATERIAL COSTS ASSOCIATED WITH THE INTRODUCTION OF THE ARBITRATION MODEL ARE INCLUDED. AN EXPLANATION OF BASIC DESIGN AND IMPLEMENTATION CONCEPTS INHERENT IN THE ARBITRATION-MODEL GRIEVANCE PROCEDURE IS FOLLOWED BY THE MECHANICAL DETAILS OF HOW TO STRUCTURE A PROCEDURE, AND HOW TO INTRODUCE IT EFFECTIVELY IN A CORRECTIONAL FACILITY. THE FINAL CHAPTER INCLUDES A SECTION ON WHAT MEANS MUST BE TAKEN TO INSTITUTIONALIZE A PROCEDURE, AND AN ANALYSIS OF LOCAL BAR ASSOCIATION MEMBERS POTENTIAL ROLES IN ESTABLISHING AND OPERATING AN ARBITRATION-MODEL GRIEVANCE PROCEDURE. APPENDED MATERIALS INCLUDE SAMPLE SURVEY QUESTIONNAIRES REGARDING EXISTING GRIEVANCE MECHANISMS, A BIBLIOGRAPHY, MODEL GRIEVANCE PROCEDURE LEGISLATION, MONITORING GUIDELINES, SAMPLE CURRICULUM IN MEDIATION AND ARBITRATION FOR ADMINISTRATORS AND MIDDLE MANAGERS, AND A SAMPLE TRAINING MANUAL ON INMATE GRIEVANCE PROCEDURES.
