THE GENERAL AND SPECIFIC IMPACT OF LEGAL CONTROLS THAT PROTECT HUMAN SUBJECTS IS DISCUSSED IN A MAJOR STUDY INVESTIGATING THE RELATIONSHIP BETWEEN LEARNING DISABILITIES AND JUVENILE DELINQUENCY.
Abstract
THIS STUDY, USING A SAMPLE OF NEARLY 2,200 DELINQUENT YOUTH, WAS DESIGNED TO DETERMINE THE PREVALENCE OF LEARNING DISABILITIES IN DELINQUENT AND NONDELINQUENT POPULATIONS, PRIMARILY IN MARICOPA COUNTY (PHOENIX), ARIZ., MARION COUNTY (INDIANAPOLIS), IND., AND BALTIMORE, MD. THE STUDY DISCUSSES THE EFFECTS OF THE DEPARTMENT OF JUSTICE'S REGULATIONS ON ACCESS TO JUVENILE JUSTICE SYSTEM RECORDS AND THE RESEARCH EXCEPTION; THE EFFECT OF STATE STATUTES ON ACCESS TO THESE RECORDS; ACCESS TO EDUCATIONAL RECORDS OF DELINQUENT AND NONDELINQUENT YOUTH; IMPLICATIONS OF THE FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT; LEAA CONTROLS ON SUBJECT PARTICIPATION AND INFORMATION USED; AND DEPARTMENT OF HEALTH, EDUCATION AND WELFARE SUBJECT PROTECTION REGULATIONS. KINDS OF RECORDS SYSTEMS, PROBLEMS OF OBTAINING DIRECTORY INFORMATION, AND AN INFORMATION TRANSFER AGREEMENTS ARE DISCUSSED. THE STUDY ALSO REVIEWS THE PRIVACY PROTECTION STUDY COMMISSION GUIDELINES AND RECOMMENDATIONS FOR INFORMATION OBTAINED FOR RESEARCH AND STATISTICAL PURPOSES. IT CONCLUDES THAT SOCIAL RESEARCH NEEDS A STRONG STATEMENT OF SUPPORT, PREFERABLY BY LEGISLATURES; THAT THE RIGHT OF INDIVIDUAL PRIVACY CANNOT BE AN ABSOLUTE; AND THAT RESEARCHERS NEED TO BECOME ADVOCATES TO ENSURE A LEGISLATIVE BALANCING BETWEEN THE RIGHT OF PRIVACY AND THE NEED FOR SIGNIFICANT SOCIAL RESEARCH.
