This article addresses the role of the legislatures and the courts to protect civil liberties.
Abstract
An analysis of the freedom to communicate is presented. The author states that television and radio have replaced individuals and groups in the communication of ideas. It is noted that even when the law is clear and the right to speak out is constitutionally protected, the specter of having to establish that right in court can have a negative effect on the average citizen. The author notes that legislatures have a responsibility to make public forums safe for robust and continuous debate. (Author abstract modified)
