This guide describes the purposes and development of Federal and State controlled substances acts (CSA's), which regulate the possession, use, sale, distribution, and manufacture of specified drugs or categories of drugs and establish penalties for CSA violations.
Abstract
The first section reviews the Federal CSA and recent amendments contained in the Anti-Drug Abuse Act of 1986. The next section provides a general overview of State CSA's and a comparative analysis of State and Federal CSA provisions. The third section provides state-by-state summaries of controlled substances acts. Each summary supplies information on scheduling, offenses, possible sentences, scope and types of forfeiture provisions, paraphernalia and imitation drug provisions, and provisions regarding offenses involving minors. Each summary also includes a narrative description of the State statute and a section highlighting unique or otherwise noteworthy provisions. Appendixes provide tables of code citations to all State CSA's and to relevant Federal statutes. There are also reference charts that identify which State statutes contain given provisions or characteristics, major elements of States' CSA penalties, and forfeitable property under State CSA's.
