THE NEED FOR INTERNATIONAL CRIMINAL CODES DEFINING CRIMES OF AN INTERNATIONAL NATURE COMMITTED BY INDIVIDUALS, AS DISTINGUISHED FROM INTERNATIONAL LAW REGULATING THE INTERCOURSE OF NATIONS, IS DISCUSSED.
Abstract
THE CRIMINAL ACTIVITIES OF INDIVIDUALS THAT HAVE INTERNATIONAL RAMIFICATIONS ARE NOT COVERED BY ANY INTERNATIONAL CRIMINAL CODE EXCEPT FOR A FEW CRIMES PROSCRIBED BY INTERNATIONAL AGREEMENTS, THE LATTER ONLY ENFORCEABLE WHEN INCORPORATED INTO THE NATIONAL CRIMINAL CODES OF THE PARTICIPATING COUNTRIES WITH LIMITED JURISDICTION. IN ADDITION, THE INTERNATIONAL CRIME STATISTICS PUBLISHED BY THE INTERNATIONAL CRIMINAL POLICE ORGANIZATION INCLUDE ONLY DATA COLLECTED AT THE NATIONAL LEVEL. WORLDWIDE HOWEVER, INCREASING ATTENTION IS GIVEN TO CRIMES COMMITTED BY INDIVIDUALS AT THE INTERNATIONAL LEVEL, IN REGARD TO THE TYPE OF CRIME (ILLEGAL TRAFFICKING AND SMUGGLING); CIRCUMSTANCES (SUCH AS THEFTS COMMITTED BY THE SAME INDIVIDUAL IN SEVERAL COUNTRIES); RAMFICATIONS (SUCH AS THE POSSIBLE INTERNATIONAL CIRCULATION OF COUNTERFEIT MONEY); AND STRIKING SIMILARITIES OF CRIMES COMMITTED IN SEVERAL COUNTRIES. ALREADY SLATED FOR POSSIBLE COMMON ACTION BY MEMBERS OF THE INTERNATIONAL POLICE ORGANIZATION ARE THEFTS (CHIEFLY OF HIGH-PRICED CARS AND ART OBJECTS) COMMITTED BY INTERNATIONALLY OPERATING CRIMINALS OR GANGS; ARMED ROBBERIES BY BORDER-CROSSING PERPETRATORS; AND KIDNAPPINGS FOR RANSOM AND HOSTAGE-TAKING INVOLVING FOREIGN NATIONALS AND DIPLOMATS (IN WHICH THE INTERNATIONAL CRIMINAL POLICE ORGANIZATION IS PREVENTED FROM INTERVENING BY ARTICLE 3 OF ITS STATUTE, (AMENDMENTS TO WHICH ARE CURRENTLY BEING DISCUSSED). ALSO BEING CONSIDERED ARE AIRPLANE HIJACKINGS (PARTIALLY COVERED BY LIMITED INTERNATIONAL AGREEMENTS) AND FRAUD ON A GLOBAL SCALE, WHICH RANGES FROM THE CASHING OF STOLEN OR COUNTERFEIT TRAVELERS' CHECKS TO THE MANIPULATION OF WORLD MONEY MARKETS. --IN ITALIAN.
