This paper tests the hypothesis that differences in the treatment of criminals on the basis of gender exist at the various stages of the criminal justice system.
Abstract
As the decision made at the different stages can be represented by categorical variables, a probit model is used to test the hypothesis using 6,747 arrest records, of which 5,226 had dispositions at the prosecutor or court. It appears that gender influences the outcome at some but not all of the stages of the criminal justice system. Further, the effect of gender on outcomes is not constant in direction.
