ARGUMENT THAT THE OVER-USE OF INCARCERATION TO DETER CRIME AND REHABILITATE OFFENDERS SHOULD BE CHANGED.
Abstract
THE AUTHOR EMPHASIZES THE ABATEMENT OF IMPRISONMENT AND RE-EXAMINATION OF THE REHABILITATIVE PHILOSOPHY CONNECTED WITH THE PRISON SYSTEM. THE USE OF INMATE PARTICIPATION IN TREATMENT PROGRAMS AS AN INDICATOR OF REHABILITATION IS REJECTED IN FAVOR OF THE 'GRADUAL TESTING OF NECESSARY CONFORMITY UNDER INCREASING MEASURES OF FREEDOM WITHIN THE MAXIMUM OF THE SENTENCE IMPOSED.' SUCH A GRADUATED RELEASE PROCEDURE, BASED ON THE PRISONER'S GOOD BEHAVIOR, WOULD BEGIN WITH REGULAR FURLOUGHS, FOLLOWED BY WORK RELEASE WHEN A JOB IS FOUND. TESTING IN A PRE-RELEASE HALF-WAY HOUSE SITUATION WOULD COME NEXT. LASTLY, THE INMATE WOULD BE TESTED IN THE COMMUNITY ON PAROLE SUPERVISION.
