THE JUDICIAL OFFICE OF UNITED STATES MAGISTRATE WAS CREATED IN 1970 TO HELP REDUCE BOTH CIVIL AND CRIMINAL CASE BACKLOG BY PERFORMING THE PRELIMINARY HEARING AND BAIL SETTING FUNCTIONS OF THE FEDERAL COURT.
Abstract
IN ADDITION, UNLESS THE DEFENDANT WISHES TO BE TRIED BY A JURY, THE MAGISTRATES HEAR ALL PETTY AND MINOR OFFENSES. THIS ARTICLE PROVIDES A BASIC GUIDE TO THE FUNDAMENTALS OF PRACTICE BEFORE THE UNITED STATES MAGISTRATE, INCLUDING CRIMINAL FILINGS AND PROCESS, BAIL, PROBABLE CAUSE, AND REMOVAL HEARINGS, AND CIVIL MATTERS AND OTHER FUNCTIONS.
