DEVELOPMENT OF GUIDELINES FOR FORMULATING A STANDARD OF REASONABLENESS TO GOVERN SEARCHES OF RELEASED OFFENDERS BY CORRECTIONAL OFFICERS.
Abstract
THE CONSTITUTIONAL STATUS OF RELEASED OFFENDERS IS REVIEWED AND THE ROLE OF CORRECTIONAL OFFICERS, INCLUDING THE RELATIONSHIP BETWEEN THEM AND THEIR CLIENTS, ARE EXAMINED. CASE LAW RELATED TO THE EXTENSION OF PROCEDURAL PROTECTIONS TO PAROLEES AND PROBATIONERS FACING REVOCATION IS ANALYZED. THE VALUE OF THE SEARCH AS A SUPERVISORY TECHNIQUE IS ASSESSED AND VARIOUS MEANS BY WHICH LEGITIMATE CORRECTIONAL OBJECTIVES CAN BE ACHIEVED WITH A MINIMAL DEGREE OF INTRUSION INTO THE PRIVACY OF RELEASED OFFENDERS.
