This book, written for attorneys dealing with Federal criminal matters, explains in detail Federal sentencing practice under the determinate guidelines established by the Sentencing Reform Act of 1984, identifies problems that led to the reform legislation, and examines the statute's legislative history in order to isolate and discuss major issues inherent in the guidelines and resulting from the relationship between the guidelines and the statute.
Abstract
Specific chapters deal with the history of the Sentencing Reform Act and Sentencing Guidelines; the composition and powers of the United States Sentencing Commission, as well as constitutional and statutory challenges to that body; and the purposes of sentencing and the Sentencing Reform Act. An overview of the sentencing guidelines is also provided, along with offense and offender characteristics and adjustments. Additional chapters deal with criminal history, drug offenses, departures from the guidelines, sentencing options, and presentence procedure. The sentencing hearing and post-sentence procedure are also examined in detail. An index, an appendix of statutes, and tables of cases and statutes are included.
