THIS 11TH ANNUAL REPORT ON THE TRUTH IN LENDING ACT DISCUSSES SIMPLIFICATION, COMPLIANCE, THE UNIFORM ENFORCEMENT GUIDELINES, THE CONSUMER ADVISORY COUNCIL, AND BOARD OF GOVERNORS FUNCTIONS.
Abstract
REFORM OF TRUTH IN LENDING THROUGH LEGISLATION OR POSSIBLE REVISION OF REGULATION Z BY THE BOARD OF GOVERNORS OF THE FEDERAL RESERVE SYSTEM IS DESCRIBED AS GUIDELINES FOR THE UNIFORM ENFORCEMENT OF THE TRUTH IN LENDING ACT AND REGULATION Z. PROGRAM AND CONFERENCE EFFORTS TO IMPROVE COMPLIANCE ARE REPORTED, AND THE VARIOUS ACTIVITIES OF THE OFFICE OF THE COMPTROLLER OF THE CURRENCY (OCC), FEDERAL TRADE COMMISSION (FTC), FEDERAL DEPOSIT INSURANCE CORPORATION (FDIC), AND NATIONAL CREDIT UNION ADMINISTRATION (NCUA) ARE OUTLINED. THE TASKS OF THE CONSUMER ADVISORY COUNCIL, ESTABLISHED IN 1976, ARE DESCRIBED BRIEFLY. IN ADDITION, THE ADMINISTRATIVE FUNCTIONS OF THE BOARD OF GOVERNORS UNDER THE TRUTH IN LENDING ACT ARE SET DOWN, INCLUDING AMENDMENTS AND INTERPRETATIONS OF REGULATION Z, PROPOSED AMENDMENTS TO REGULATION Z, SIGNIFICANT LITIGATION, AND EDUCATION. EDUCATIONAL MATERIALS PROVIDED IN 1979 BY THE FEDERAL RESERVE SYSTEM INCLUDED PRODUCTION OF 3 MILLION COPIES OF THE CONSUMER HANDBOOK TO CREDIT PROTECTION LAWS AS WELL AS FILMS, WORKSHOPS AND LECTURES, AND TELEVISION SPOT ANNOUNCEMENTS RELATED TO CONSUMER CREDIT EDUCATION. LEGISLATIVE RECOMMENDATIONS INCLUDE LIMITED CONSUMER LIABILITY FOR LOST OR STOLEN CREDIT CARDS, AMENDMENT OF THE FAIR CREDIT BILLING ACT AND THE ELECTRONIC FUND TRANSFER ACT TO COVER TELEPHONE CREDIT CALLS AND TO PROHIBIT INVESTIGATORY CHARGES, PERIODIC RIGHTS STATEMENTS, AND CLARIFICATION OF THE LEGAL RELATIONSHIP BETWEEN ELECTRONIC FUND TRANSFER AND CREDIT TRANSACTIONS. OTHER AGENCY RECOMMENDATIONS ARE LISTED. NO NEW STATE EXEMPTIONS FROM THE REQUIREMENTS OF CHAPTER 2 OF THE TRUTH IN LENDING ACT WERE GRANTED IN 1979. (AOP)
