THE EXPERIENCES OF THE CHIEF JUDGE OF THE FAMILY COURT OF THE STATE OF DELAWARE ARE DRAWN UPON IN THIS DISCUSSION OF THE REQUIREMENTS FOR A WELL-PLANNED, EFFECTIVE FAMILY COURT.
Abstract
THE AUTHOR DISCUSSES THE FOLLOWING TRAITS AS ESSENTIAL TO THE EFFECTIVENESS OF THE COURT: (1) A COURT THAT ADHERES FIRMLY TO LEGAL PRINCIPLES AND HAS RESOURCES AVAILABLE TO CORRECT (WITH MINIMAL INTERVENTION) THE INDIVIDUAL INTO COURT; (2) A COURT THAT HAS BROAD SUBSTANTIVE AND GEOGRAPHIC JURISDICTION OVER FAMILY MATTERS AND PROPER STATUS AND ACCESS TO RESOURCES; AND (3) A COURT THAT HAS A CLEAR-CUT, STRAIGHT-LINE CHAIN OF COMMAND AND RESPONSIBILITY IN JUDICIAL AND ADMINISTRATIVE AREAS.
