THIS 1971 COLLECTION OF READINGS SURVEYS THE THEN CURRENT SEARCH FOR A RECONCILIATION OF THE CLASH BETWEEN THE FUNDAMENTAL CONSTITUTIONAL GUARANTEES OF FAIR TRIAL AND FREE PRESS.
Abstract
THE VOLUME BEGINS WITH THE TWO ARTICLES WHICH PRESENT THE FAIR TRIAL-FREE PRESS CONFLICT IN CONTEMPORARY AND HISTORICAL PERSPECTIVE. THIS INTRODUCTORY MATERIAL IS FOLLOWED BY FIVE ARTICLES IN WHICH LEADERS OF THE BENCH, BAR AND NEWS MEDIA APPRAISE THE SCOPE OF THE PRESENT CONFLICT AND POSSIBLE SOLUTIONS. FOLLOWING THESE APPRAISALS, FOUR ARTICLES EXAMINE SPECIFIC METHODS OF ACCOMMODATING THE GUARANTEES OF FREE PRESS AND FAIR TRIAL. THEIR FOCUS IS THE ABILITY OF THE COURTS TO CONTROL ACCESS TO INFORMATION ABOUT CRIMINAL PROCEEDINGS. THE FINAL FOUR ARTICLES ALSO EXPLORE MEANS OF ACCOMMODATING THE GUARANTEES OF FREE PRESS AND FAIR TRIAL. THEIR FOCUS, HOWEVER, SHIFTS TO THE POSSIBILITY OF A PARTNERSHIP BETWEEN THE COURTS AND THE MEDIA WITH EMPHASIS ON COURT SUPERVISION RATHER THAN COURT CONTROL. FOLLOWING THE ARTICLES, THE AMERICAN BAR ASSOCIATION STANDARDS RELATING TO FAIR TRIAL AND FREE PRESS, THE TEXT OF THE WASHINGTON SUPREME COURT OPINION IN STATE EX. REL. SNOHOMISH COUNTY V. SPERRY (1970), THE REPORT OF THE COMMITTEE ON THE OPERATION OF THE JURY SYSTEM FOR THE 'FREE PRESS-FAIR TRIAL' ISSUE AND AN EDITORIAL ON GUIDELINES FOR THE PRESS AND POLICE ARE APPENDED. A SELECTED BIBLIOGRAPHY OF RECENT WORKS IN THE FIELD IS ADDED TO FACILITATE FURTHER RESEARCH. (AUTHOR ABSTRACT)
