REVIEW OF THE METHODS USED AND THE DATA COLLECTED IN RESEARCH STUDIES ON JUDICIAL SENTENCING AND THEIR RELIABILITY FOR MEASURING DISCRIMINATION IN SENTENCING.
Abstract
NEW DIRECTIONS IN RESEARCH ARE PROPOSED TO STUDY VARIABLES AFFECTING SENTENCING. THE AUTHOR SUGGESTS THE COLLECTION OF LONGITUDINAL DATA BASED ON THE DEFENDANTS' TRANSIT THROUGH THE CRIMINAL JUSTICE SYSTEM. ADDITIONAL ATTENTION TO VARIABLES AS THE EFFECTS OF ORGANIZATIONAL CONSTRAINTS LIKE CASELOADS AND COURT REFERRAL RATES, COMMUNITY FACTORS LIKE RECIDIVISM RATES AND PUBLICITY GIVEN CERTAIN TYPES OF CRIME, AND THE IMPORTANCE OF CHARACTERISTICS OF SENTENCING JUDGES IS RECOMMENDED IN CONJUNCTION WITH LONGITUDINAL STUDIES.
