BACKGROUND AND OUTLINE FOR A PROPOSED NATIONAL EFFORT TO STIMULATE PRETRIAL DIVERSION PROGRAMS FOR ADULT AND JUVENILE OFFENDERS.
Abstract
THE PRE-TRIAL DIVERSION PROJECT TYPICALLY CALLS FOR STOPPING THE PROSECUTION CLOCK ON LESS SERIOUS OR FIRST FELONY OFFENDERS AT THE ARRAIGNMENT STAGE. THOSE SELECTED FOR THE PROGRAM ARE OFFERED COUNSELING, JOB PLACEMENT, EDUCATION AND SUPPORTIVE PERSONAL SERVICES. IF THE OFFENDER RESPONDS FOR A MEASURABLE PERIOD (E.G., 3-6 MONTHS), THE COURT, WITH PROSECUTOR CONCURRENCE, IS ASKED TO APPROVE DISMISSAL OF THE CASE PRIOR TO TRIAL AND ADJUDICATION. THE SUCCESSFUL PROGRAMS IN WASHINGTON, DC AND NEW YORK CITY ARE REVIEWED AND ONGOING PROGRAMS IN OTHER CITIES ARE NOTED. THERE FOLLOWS A DETAILED PROPOSAL FOR IMPLEMENTING A NATIONAL CLEARINGHOUSE OF PRETRIAL DIVERSION INFORMATION BY THE AMERICAN BAR ASSOCIATION AND NATIONAL DISTRICT ATTORNEYS ASSOCIATION.
