This chapter discusses the fashioning of alternative sentences and presents case summaries for alternative sentences imposed in municipal, State, and Federal courts for homicide; sexual assault; assault and battery; arson; robbery; burglary; theft; drug law offenses; drunk driving; white-collar crimes; and cases involving chronic offenders.
Abstract
The discussion notes that the homicide alternative sentences sought to accomplish the same goals as traditional sentences, including punishment, reparation, rehabilitation, incapacitation, deterrence, and just deserts, but they relied on something other than the use of traditional probation and long-term incarceration. Their common components were usually specific, nontraditional probation conditions. Sentences for other offenses were also designed to accomplish the same goals as traditional sentences. Factors that defense attorneys, prosecutors, probation officers, and judges must consider in fashioning alternative sentences include the offender, the offense, the victim, the community at large, and the individual court environment.
