THIS EVALUATION SUGGESTS THAT THE NORTH CAROLINA HABITUAL OFFENDER (HO) LAW IS REDUNDANT WITH RESPECT TO EXISTING DRIVER'S LICENCE REVOCATION LAWS AND INEFFECTIVE WITH RESPECT TO SUBSEQUENT DRIVER IMPROVEMENT.
Abstract
THE PERCENTAGE OF DRIVERS ELIGIBLE FOR HO STATUS (OVER A SEVEN YEAR PERIOD HAVING ACCUMULATED TWELVE MOVING VIOLATIONS OR THREE MAJOR VIOLATIONS) WAS LESS THAN TWO-TENTHS OF ONE PERCENT OF THE DRIVER POPULATION. THIS GROUP, COMPARED TO THE GENERAL DRIVING POPULATION, HAS A HIGHER PROPORTION OF MALES, NONWHITES, MIDDLE-AGED PERSONS, AND PERSONS HOLDING CHAUFFEUR LICENSES. IT WAS FOUND THAT SOME PROSECUTING ATTORNEYS WILL NOT PROSECUTE UNDER THIS LAW BECAUSE THEY FELT THAT EXISTING LAWS WERE ADEQUATE TO HANDLE THE PROBLEM.
