The essays included in this volume focus on therapeutic jurisprudence, that is, the extent to which substantive rules, legal procedures, and the roles of lawyers and judges produce therapeutic or antitherapeutic consequences.
Abstract
Specific applications of therapeutic jurisprudence accompany an initial section devoted to general matters. Two chapters explicate the concept of therapeutic jurisprudence and contain an overview. Subsequent chapters discuss competency to consent to treatment and hospitalization, consider the psychological literature on patient choice and competency to consent to admission to a mental hospital, tort regulation and the therapeutic enterprise, and directing patient motivation to comply with a suggested therapeutic course. Concluding chapters address teaching therapeutic jurisprudence in law schools and other professional or interdisciplinary settings and the ways therapeutic jurisprudence can frame a new research agenda for mental health law. 1,006 footnotes
