UNDER THE DRUG OFFENDER DIVERSION LAW (PENAL CODE, SECTION 1000), COURT PROCEEDINGS CAN BE SUSPENDED FOR A PERIOD OF SIX MONTHS TO TWO YEARS FOR CERTAIN FIRST-TIME DRUG OFFENDERS.
Abstract
THOSE DIVERTED FROM THE COURT SYSTEM ARE REFERRED TO COMMUNITY RESOURCES FOR EDUCATION, TREATMENT, OR REHABILITATION, AND CRIMINAL CHARGES ARE DISMISSED UPON SUCCESSFUL COMPLETION OF THE PROGRAM. INDIVIDUALS MAY BE DIVERTED FOR POSSESSION OF MARIJUANA, NARCOTICS, DANGEROUS DRUGS, AND/OR PARAPHERNALIA, AND FOR VISITING A PLACE WHERE NARCOTICS ARE BEING USED. THIS REPORT DESCRIBES THE STATEWIDE MOVEMENT OF 1000 P.C. DIVERSION CASES DURING 1973 AND 1974 AND THE VARIOUS CHARACTERISTICS OF DEFENDANTS PLACED ON AND REMOVED FROM THE PROGRAM. IN ADDITION TO STATEWIDE PROGRAM TABLES AND ANALYSES, 1974 LOCAL AGENCY TABLES ARE INCLUDED FOR EACH PARTICIPATING COUNTY. THE APPENDIX CONTAINS A COPY OF P.C. 1000 AND A JUDICIAL INTERPRETATION OF THE PROVISION.
