A PAKISTANI JUDGE DISCUSSES THE CAUSES OF DELAY WHICH OPERATE INDEPENDENTLY OF PRESCRIBED PROCEDURE AND GENERALLY ARISE OUT OF THE ADMINISTRATIVE, SOCIAL, AND ECONOMIC FACTORS IN THE CRIMINAL COURTS IN PAKISTAN.
Abstract
THE MAIN FACTORS ARE DELAY IN INVESTIGATION, NON-ATTENDANCE OF WITNESSES OR ACCUSED, DILATORY TACTICS OF DEFENSE LAWYERS, INCREASED WORKLOAD AND SHORTAGE OF COURTS, FREQUENT ADJOURNMENTS, STAY OF PROCEEDINGS AND NON-RECEIPT OF RECORD, AND LACK OF PROPER WORKING CONDITIONS. IN PUNJAB, THE LARGEST OF PAKISTAN'S FOUR PROVINCES, THE CASES PENDING AS OF JUNE, 1975 INCLUDED 29,000 CASES PENDING FOR MORE THAN A YEAR AND 37,000 CASES PENDING FOR MORE THAN SIX MONTHS.
