THIS AUDIO VISUAL PACKAGE ON DEFINING CRIME IS DESIGNED FOR POLICE INSTRUCTORS AND TRAINEES WHO NEED TO KNOW HOW THE CRIMINAL JUSTICE SYSTEM IS ORGANIZED AND HOW IT OPERATES.
Abstract
THREE KEY WORDS USED IN DEFINING CRIME ARE DISCUSSED, AND DIFFERENT WAYS OF CLASSIFYING CRIME ARE PRESENTED. CRIMES, BRIEFLY DEFINED AS ACTS OR OMISSIONS PUNISHABLE BY LAW, MUST BE (A) PROHIBITED, (B) PUBLIC, AND (C) PUNISHABLE. PROHIBITION IS DECIDED BY CONGRESS AND THE STATE LEGISLATURES THROUGH THE PASSAGE OF GENERAL LAWS OR STATUTES. PUNISHMENT IS DECIDED BY THE STATE WHICH UNUALLY SETS PENALTIES OF FINES, IMPRISONMENT, OR, AT THE MOST EXTREME, EXECUTION. CRIMES CAN BE CLASSIFIED AS AGAINST PERSONS, PROPERTY, OR HABITATION, AS EVIL IN AND OF THEMSELVES OR SIMPLY PROHIBITED (MALA IN SE AND MALA PROHIBITA), OR BY THE DEGREE OF PUNISHMENT IMPOSED BY THE COURTS. FELONIES, FOR EXAMPLE, ARE CRIMES USUALLY PUNISHABLE BY DEATH; A FINE IN EXCESS OF $1,000, DEPENDING ON THE JURISDICTION; OR IMPRISONMENT FOR MORE THAN A YEAR. CRIMINAL LAW CONSISTS OF ALL THE VARIOUS OFFENSES, DEFINITIONS, AND RULES GOVERNING THEIR ENFORCEMENT AND HAS ITS ROOTS IN THE COMMON LEGAL EXPERIENCE OF THE ENGLISH PEOPLE.
