THIS TWO-VOLUME SOURCEBOOK IS DESIGNED AS A BASIC RESEARCH AND REFERENCE TOOL FOR LAWYERS AND JUDGES IN THE STATUTORY AND LEGISLATIVE DOCTRINE OF CRIMINAL PROCEDURE.
Abstract
ALTHOUGH MANY POINTS OF DOCTRINE ARE DEALT WITH THROUGH EDITORIAL NOTES, THE APPROACH TAKEN HERE IS TO INCLUDE BASIC STATUTORY MATERIAL AND LEADING CASES AS THE LAUNCHING POINT FOR EACH MAJOR SUBJECT, FOLLOWED BY THE EDITOR'S TEXT AND OTHER AMPLIFYING MATERIAL, THE ORGANIZATION OF THE SOURCEBOOK FOR THE MOST PART PARALLELS THE PROGRESSION OF EVENTS IN A CRIMINAL PROSECUTION. WHEN PLACEMENT OF MATERIALS IS A MATTER OF PERSONAL CHOICE, THE EDITOR HAS INCLUDED APPROPRIATE CROSS-REFERENCES TO OTHER PARTS OF THE BOOK FOR INITIAL CONSULTATION. ONLY REPRESENTATIVE CITATIONS ARE USED, OFTEN REFLECTING RECENT APPLICATIONS OF LEGAL RULES AND NOT THE EARLIEST AS THESE ARE USUALLY AMPLY CITED IN LATER DECISIONS. AS FAR AS POSSIBLE, ALL KEY SUPREME COURT DECISIONS HAVE BEEN EXTRACTED OR CITED TO FACILITATE FAMILIARIZATION WITH CONTROLLING CONSTITUTIONAL DOCTRINE. THE FIRST VOLUME COVERS CRIMINAL PROCEDURE RELATED TO ARREST, SEARCHES AND SEIZURES, CONFESSIONS, CRIMINAL IDENTIFICATION, PRELIMINARY PROCEEDINGS AND PREPARATION OF THE FORMAL TRIAL PLEADINGS, AND ARRAIGNMENT AND PRETRIAL MOTIONS. CHAPTERS IN THE SECOND VOLUME CONSIDER JURY IMPANELMENT, TRIAL PRACTICE AND EVIDENCE, SENTENCING AND PUNISHMENT, POST-TRIAL MOTIONS AND APPEAL, POST-CONVICTION REMEDIES, AND JUVENILE PROCEEDINGS. DECISIONS OF THE SUPREME COURT THROUGH JANUARY 30, 1976 ARE COVERED. (SNI ABSTRACT)
