This supplement to the second edition of 'Criminal Procedure: An Analysis of Cases and Concepts' analyzes 1986-87 and 1987-88 U.S. Supreme Court decisions pertinent to the fourth and fifth amendments, entrapment, pretrial process, adjudication of guilt, the role of defense counsel, and the relationship between the Federal and State courts.
Abstract
The decisions rendered under fourth amendment interpretations pertain to the exclusionary rule, when 'searches' occur and when they are reasonable, search-warrant and probable-cause requirements, plain view, regulatory inspections and searches, and electronic surveillance. Topics under the fifth amendment are who may assert the privilege against self-incrimination, compulsion and waiver, the 'testimonial evidence' requirement, and confessions. Decisions regarding pretrial process concern pretrial detention and release, the grand jury, and the prosecutor's duty to disclose evidence to the defense. Issues the Court considered in the adjudication of guilt are the right to speedy trial, plea bargaining, the right to public jury trial, trial rights, and appeals. Other matters addressed by the Court are the right to counsel, effective assistance of counsel, Federal habeas corpus, and State court departures from Federal standards. Table of cases.
