Abstract
The topics covered include State crimes with subsections on the validity of criminal statutes in general, construction and operation of criminal statutes, nature and elements of specific crimes, capacity, parties, and defenses. State criminal procedures, ancillary proceedings (with subsections jurisdiction and venue; preliminary proceedings; indictment and information; and pretrial motions are also reviewed. Discovery; guilty pleas; evidence; trial; jury; post-trial motions; sentencing and punishment; and appeal and error are discussed as are (probation, parole, and pardon; prisoner proceedings; ancillary proceedings); Federal crimes; and Federal procedures. Constitutional guarantees are investigated with subsections on admissions and confessions, confrontation of witnesses, right to counsel, cruel and unusual punishment, double jeopardy, due process, equal protection, ex post facto, freedom of the press, freedom of speech and expression, identification procedures, and including right to jury trial, propriety of exercise of police power, retroactivity of constitutional rulings, prohibition against unlawful searches and seizures, prohibition against self-incrimination, and right to speedy trial.
