The victim's contribution to the criminal justice system is now starting to be recognized but his role within it remains problematic. The research relating to the position of victims in the criminal justice system is reviewed.
Abstract
Their position in relation to the substantive criminal law and the implications for the victim of compensation from the offender within the auspices of the criminal justice system are discussed. It is argued that the neglect of victims by lawyers, the police and the judiciary is endemic, with its roots in their non-recognition by the substantive law. The results of this cause difficulties for the practical operation of the system. They point to the need for a conscious adoption of a model of criminal justice which gives the victim an acknowledged status. (Author abstract)
