THE EXPANSION OF FEDERAL SUPERVISION OF CRIMINAL JUSTICE IN THE STATES HAS RESULTED IN A CASELOAD EXPLOSION AT EVERY LEVEL OF THE COURT SYSTEM, IMPLICATING THE ABILITY OF THESE COURTS TO ADMINISTER JUSTICE.
Abstract
MAJOR PROPOSALS FOR REMEDYING THE EXISTING CASELOAD CRUNCH INCLUDE ELIMINATING JURISDICTION FOR DIVERSITY OF CITIZENSHIP CASES, NARROWING THE CONDITIONS UNDER WHICH HABEAS CORPUS PETITIONS FROM STATE PRISONERS CAN BE ENTERTAINED BY FEDERAL DISTRICT JUDGES; AND DECRIMINALIZATION OF VICTIMLESS CRIMES. THE CREATION OF A NATIONAL COURT OF APPEALS TO ALLEVIATE SOME OF THE CASELOAD BURDENS OF THE SUPREME COURT HAS ALSO BEEN SUGGESTED.
