This 1996 Supplement to Cases and Materials on Criminal Justice Administration contains primarily decisions of the U.S. Supreme Court on matters pertinent to the investigation of crime, prosecution, and adjudication up to the Court's summer recess of its October 1995 term.
Abstract
Court decisions relevant to the investigation of crime address the exclusionary sanction, constitutional doctrines that relate to law enforcement conduct, and the issuance and execution of arrest and search warrants. Other cases that bear upon criminal investigations relate to the detention of persons and related searches, "warrantless" searches, interrogation and confessions, undercover investigation, and grand jury investigative functions. Cases relevant to prosecution focus on the initial appearance and detention, prosecutorial discretion, the preliminary examination and the grand jury, the right to a speedy trial, and competency to stand trial. Other cases that bear upon prosecutorial responsibilities considered discovery and disclosure, the right to an impartial trial, joinder and severance of charges and defendants, and double jeopardy. Cases pertinent to adjudication dealt with the following issues: adjudication of guilt by plea, adjudication of guilt or innocence by trial, effective assistance of counsel, sentencing, and appeal and collateral attack. In addition to presenting the case decisions, the authors also critique and interpret the decisions. A table of cases
