A CRITIQUE OF INSTITUTIONALIZED INTERNMENT FOR MENTALLY-ILL OFFENDERS IN ITALY BASED ON THE DIRECT TESTIMONIES OF INMATES, DOCTORS, SURVEILLANCE MAGISTRATES AND STAFF.
Abstract
THIS BOOK - WHICH IN ITS CENTRAL PART CONTAINS A DETAILED REPORT ON THE LIVING CONDITIONS OF PEOPLE DETAINED IN SEVERAL CRIMINAL ASYLUMS IN ITALY - IS AN OPEN DENUNCIATION OF THE CURRENT PENITENTIARY REGULATIONS, AND, IN PARTICULAR, AGAINST THE AFFLICTIVE CHARACTER OF DETENTIVE SECURITY MEASURES. THESE MEASURES, ACCORDING TO THE PENAL CODE, CANNOT BE LIKENED TO IMPRISONMENT, HAVE AN ADMINISTRATIVE CHARACTER, AND SHOULD PERFORM A PREVENTIVE FUNCTION IN THEIR IMPLEMENTATION. THE AUTHOR FINDS, HOWEVER, THAT THEY CONSTITUTE AN ACTUAL ADDITION TO AND AN AGGRAVATION OF DETENTION. DETENTIVE SECURITY MEASURES ARE INDETERMINATE SENTENCES, ADDITIONAL TO THE MAIN SENTENCE, BASED ON THE SOCIAL DANGEROUSNESS OF THE SUBJECT AND PERIODICAL RE-EXAMINATION BY THE SURVEILLANCE MAGISTRATE. THEY ARE INFLICTED UPON SO-CALLED HABITUAL, PROFESSIONAL OR MENTALLY-ILL OFFENDERS. IT IS TO THE INSTITUTIONS' PREDISPOSED TO THIS LATTER TYPE OF OFFENDERS THAT THE CRITIQUE OF THE AUTHOR IS PRIMARILY DIRECTED. THE BOOK CONTAINS AN APPENDIX BY DIFFERENT AUTHORS WITH PROPOSALS FOR A RE-EXAMINATION OF THE CONCEPT OF SOCIAL DANGEROUSNESS AND PREVENTIVE REPRESSION.
