THIS MANUAL FOR PEACE OFFICERS DEFINES ARREST, CLEARLY OUTLINES PROCEDURES, DESCRIBES SITUATIONS THAT NEED A WARRANT, IDENTIFIES THOSE WITH AUTHORITY TO MAKE ARRESTS, AND OUTLINES RIGHTS AND DUTIES.
Abstract
PROCEDURES FOR CRIMINAL ARREST HAVE BEEN AFFECTED BY RECENT SUPREME COURT DECISIONS, PARTICULARLY THOSE DEALING WITH THE RIGHTS OF THE ACCUSED. THIS HANDBOOK FOR THE ARRESTING OFFICER PROVIDES COMPREHENSIVE INFORMATION INCORPORATING THESE CHANGES. THE DIFFERENCES BETWEEN ARREST, TECHNICAL ARREST, INVESTIGATIVE DETENTION, AND STOP AND FRISK ARE EXPLAINED. THE LIMITED AND EXCEPTIONAL CASES IN WHICH A WARRANT IS NOT REQUIRED ARE DESIGNATED, ALONG WITH THOSE IN WHICH IT IS. REQUIREMENTS TO BE MET BEFORE A WARRANT CAN BE ISSUED ARE LISTED, ALONG WITH DESCRIPTIONS OF THOSE WHO CAN MAKE ARRESTS AND UNDER WHAT CIRCUMSTANCES.
