Guidance is provided defense attorneys in the areas of the economics of criminal practice, handling a publicized case, cross-examining police officers, analysis of blood stain patterns, plea bargaining, the disqualification of judges and prosecutors, business records, and anatomy of a criminal case.
Abstract
The economics of criminal practice is discussed in terms of the size and structure of law firms, the fee arrangement, and particularly fees in a criminal case. The impact of publicity on criminal trials is examined, with particular attention to handling the impact, how the State's generation of publicity against the defendant leads to dismissal, and special problems faced by the defense. Other chapters review flight characteristics and stain patterns in human blood, plea bargain agreements and the enforcement of plea bargains, procedures for disqualifying prosecutors and judges for both California and Federal courts, and business records and the fifth amendment. A final section on the anatomy of a criminal case examines (1) motions in a gambling prosecution involving wiretapping and electronic eavesdropping, (2) motions in a prosecution for receiving or possessing stolen property, (3) motions in a false notarization prosecution, (4) motions in a perjury prosecution, and (5) motions in a rape case involving the loss or destruction of forensic evidence. Figures, photographs, and references are provided.
