This article considers creativity and conditional sentencing.
Abstract
The conditional sentence attempts to positively influence convicts’ behavior and to reduce imprisonment by substituting rules of behavior for incarceration. An important part of the conditional sentence is the possibility of tailoring conditions to the individual convict. The Dutch Minister of Justice proposes to limit the possible individualization of sanctioning. The article argues that regulation of the conditional sentence should be modernized. Notes, references
