This booklet provides Minnesota county attorneys with a ready reference of an overview of the responsibilities and duties of the office, so as to assist in the orientation of assistant county attorneys and the education of the public regarding county attorneys' role.
Abstract
Minnesota statutes assign a variety of responsibilities and duties to the county attorney; they involve criminal justice functions as well as a variety of civil functions. Responsibilities for civil actions are presented under the mandates of executive departments to ensure public rights, the mandates of various governmental departments and agencies, commercial and police regulations, State subdivisions, private rights (property interests and liens), and judicial remedies. Responsibility for civil advice and reviews of a specific nature are also discussed for the aforementioned areas and agencies. Other statutory duties specified pertain to being an advisor/counselor to agencies and officials, being responsible for filing reports, and performing civil and criminal responsibilities that do not involve litigation. A presentation of general prosecution responsibilities focuses on the enforcement of commercial and police regulations and prosecutory responsibilities in counties and cities. A presentation of specific prosecution responsibilities delineates them by executive departments and agencies, commercial and police regulations, cities, private rights (domestic relations and estates of decedents), and judicial remedies (those controlling personal action and judicial proof).
