Abstract
This publication presents the Convention on the Counterfeiting of Medical Products and Similar Crimes Involving Threats to Public Health developed by the Council of Europe and adopted by its member states and other signatories. The purpose of the Convention is to prevent and combat threats to public health as a result of crimes involving the counterfeiting of medical products. The scope of the Convention covers all aspects of medical products, from finished products to parts and accessories, regardless of whether or not they are covered under intellectual property laws. The Convention is enumerated in 11 chapters, all of which are presented in this publication: Chapter I: Object and purpose, principle of non-discrimination, scope, definitions; Chapter II: Substantive criminal law; Chapter III: Investigation, prosecution and procedural law; Chapter IV: Co-operation of authorities and information exchange; Chapter V: Measures for prevention; Chapter VI: Measures for protection; Chapter VII: International co-operation; Chapter VIII: Follow-up mechanism; Chapter IX: Relationship with other international instruments; Chapter X: Amendments to the Convention; and Chapter XI: Final clauses.
