This survey reviews the various Federal efforts, including statutes, executive orders, and judicial interpretations, to prevent conflict of interest for Federal employees.
Abstract
The Federal legislative regulation explained addresses unauthorized compensation, activities of officers and employees, post-employment activities, acts that affect personal financial interest, and salaries of government officials. The discussion of each of these areas where conflict of interest may arise indicates the types of Federal employees covered under the legislation, elements that must be proven to establish that an offense has been committed, and defenses to charges under the legislation. The description of executive branch-wide ethics regulations focuses on a proposed rule that would rewrite 5 C.F.R. part 2635 to establish uniform ethical standards for all executive branch employees. The proposed rule was issued to implement President Bush's 1989 and 1990 executive orders on ethics. The proposed rule is designed to counter ethical improprieties that pertain to gifts from outside sources, conflicting financial interests, impartiality in performing official duties, and seeking other employment. 185 footnotes
