In this report, the Australian Law Reform Commission reviews issues related to compliance with the consumer protection provisions of the Trade Practices Act 1974 (TPA).
Abstract
The TPA seeks to promote competition in the Australian economy, thereby benefiting consumers through lower prices, better quality products, and increased innovation. This paper describes the roles of the Trade Practices Commission (TPC) and the courts in responding to contraventions of the Act. A discussion of compensation to persons who suffer loss or damages covers assessment of damages, compensation for breach, dissipation of assets, access and cost issues, and lemon laws. Subsequent chapters examine issues including undoing the effects of a contravention, preventing further contraventions, deterring contraventions, administrative powers of the TPC, preventive measures, and court procedures.
