Chapter 117 of Title 20 of Vermont statutes creates the Vermont Criminal Information Center within the Department of Public Safety. The Center is required to develop and administer a uniform and complete State, interstate, national, and international system of records of criminal activities and information. The Center is mandated to provide State agencies and political subdivisions with uniform forms for the reporting of specified crime-related information. Executive Order No. 31 establishes the Security and Privacy Committee. Its specified duties include adopting policy positions on security and privacy issues concerning information systems at the State and local levels, as well as implementing and enforcing procedures designed to ensure the security and privacy of personal information. Chapter 5 of Title 1 of Vermont statutes provides for free and open examination of public records consistent with the State constitution. Records that are exempt from such examination include records designated confidential by law and records that deal with the detection and investigation of crime, including those maintained on any individual or compiled in the course of a criminal or disciplinary investigation by any police or professional licensing agency. The commissioner of education may obtain from the Vermont Crime Information Center the record of criminal convictions of any person applying for an initial license as a professional educator. A provision pertinent to the Department of Social Welfare specifies that the commissioner of the department may obtain from the Crime Information Center the record of convictions of any person when such information is necessary to regulate a facility or individual subject to regulation by the department. Also included in this compendium are the rules and regulations that govern the operation of the Vermont Criminal Information Center as instituted in 1979.
