This is a 1997 overview of Pennsylvania law pertinent to the privacy and security of criminal justice information.
Abstract

Chapter 91 of Part III of Title 18 of the Pennsylvania Criminal Code (Criminal History Record Information Act) addresses criminal history record information. It applies to persons within the State and to any State agency or political subdivision that collects, maintains, disseminates, or receives criminal history record information. Following a subchapter on general provisions, a subchapter addresses the completeness and accuracy of criminal history record information. Sections in the latter subchapter focus on the duties of criminal justice agencies regarding data collection, mandatory fingerprinting, disposition reporting by criminal justice agencies, and the correction of inaccurate information. A subchapter on the dissemination of criminal history record information sets standards for expungement of information, juvenile records, the use of records by licensing agencies, and the use of records for employment purposes. Other subchapters of the Criminal History Record Information Act address data security, the annual audit of repositories, the individual right of access and review, the responsibility of the attorney general, public notice, and sanctions. Title 61 and Title 65 are also included in the compendium. They focus on records that pertain to the identification of criminals and the management of access to public records.
