OBJECTIVES, METHODOLOGY, AND CONCLUSIONS OF A STUDY DESIGNED TO INCREASE UNDERSTANDING OF FELONY PROCESSING THROUGH COMPARISON OF PROCESSING IN THREE JURISDICTIONS.
Abstract
KEY FACTORS IN THE FELONY PROCESSING SYSTEM ARE THE DEFENDANT'S STATUS, TYPE OF COUNSEL, DISPOSITION OF CASE, SENTENCE, CONTINUANCE, CONSOLIDATION OF CASE, MOTIONS, CHARGE, AND QUESTION OF MULTIPLE DEFENDANTS. THE STUDY IDENTIFIES THE MAJOR DISSIMILARITIES IN FELONY PROCESSING SYSTEMS - THE PRESENCE OF PROVISION OF PUBLIC DEFENSE COUNSEL, OPERATION BY GRAND JURY OR INFORMATION, OR EXISTENCE OF ADEQUATE PRELIMINARY HEARINGS. A DATA BASE WAS DEVELOPED FOR USE IN IDENTIFYING VOLUME AND TYPES OF CASES PROCESSED. AN APPENDIX PRESENTS STATISTICAL DATA RESULTING FROM THE STUDY.
