Abstract
THIS VOLUME IS ONE OF NINE IN A SERIES OF WORKING PAPERS OF THE NATIONAL TASK FORCE TO DEVELOP STANDARDS AND GOALS FOR JUVENILE JUSTICE AND DELINQUENCY PREVENTION. ISSUES WITHIN EACH ANALYSIS ARE ORGANIZED BY TITLE, DESCRIPTION, SUMMARY OF MAJOR POSITIONS, SUMMARY OF STATE PRACTICES, SUMMARY OF POSITIONS RECOMMENDED BY OTHER STANDARDS GROUPS, ANALYSIS, AND TASK FORCE STANDARDS AND RATIONALE. SECTION A OF THIS VOLUME CONSIDERS THE NEED FOR JUVENILE COURT RULES AND DISCUSSES INITIAL APPEARANCE, PRETRIAL DETENTION, THE RIGHT TO A DETENTION HEARING, AND APPROPRIATE CONDITIONS FOR RELEASE OR APPEAL AS A RESULT OF SUCH A HEARING. ALSO DISCUSSED IN THE SECTION ARE ISSUES OF WAIVER OF COUNSEL, CUSTODIAL ADMISSIONS, PROBABLE CAUSE HEARINGS, EVIDENTIARY RULES AND PROCEDURAL RIGHTS, AND PLEA BARGAINING WITHIN THE JUVENILE PROCESS. SECTION B EXCLUSIVELY CONSIDERS ISSUES RELATED TO DISCOVERY IN JUVENILE PROCEEDINGS SUCH AS PROCEDURE AND THE TYPE OF EVIDENCE THAT SHOULD BE DISCOVERABLE.
