This analysis of delays in case processing in the Philippines notes that the causes of these delays can be grouped into four categories: institutional factors, the practices of some judges, factors related to court personnel, and factors related to court-related agencies.
Abstract
Specific factors include the adversarial nature of the judicial process, the use of split trials, attorneys' delaying tactics, large caseloads of attorneys, attorney incompetence and failure to prepare for trial, judges' incompetence and ignorance of the law, large court caseloads, delay in the service of notices, poor postal service, and uncommitted warrant servers. Measures taken to reduce delays include revisions in criminal procedure, pre- trial conferences, improved inventories of court dockets, law reforms, and interagency agreements.
