Colorado has enacted legislation that covers responsibilities of the Colorado Bureau of Investigation, access to public records, and the handling and inspection of criminal justice records.
Abstract
The Colorado Bureau of Investigation is charged with investigating organized crime and operating the Uniform Crime Reporting Program. Legislative provisions stipulate that all public records must be open to inspection by any individual or organization, except as otherwise restricted by law, and identify procedures and grounds for denying public record inspections. Criminal justice agencies are responsible for maintaining records of official actions, and these records must also be open to public inspection, except as otherwise restricted by law. Criminal justice records include arrest and criminal records, and individuals have the right to challenge the accuracy and completeness of their criminal justice records. In addition, Colorado legislation contains provisions on record sealing and penalties for failure to comply with public record inspections.
