RECENT AND POTENTIAL CIVIL COURT ACTIONS RESULTING FROM IMPROPER POLICE TRAINING.
Abstract
THIS PAPER DISCUSSES A SUBSTANTIAL NUMBER OF COURT CASES IN ORDER TO ILLUSTRATE THE PROPER LEVELS OF TRAINING TO AVOID DEPARTMENTAL LIABILITY FOR MISTRAINING OR LACK OF TRAINING OF THE INDIVIDUAL POLICE OFFICER. THE KINDS OF SITUATIONS WHICH THE CASES COVER ARE - FIREARMS ACCIDENTS, NEGLIGENCE, INVASION OF PRIVACY, FALSE IMPRISONMENT, EMERGENCY AND PURSUIT DRIVING, MISUSE OF ARREST POWERS, AND MALICIOUS PROSECUTION. IT IS SUGGESTED THAT POLICE DEPARTMENTS FAMILIARIZE THEMSELVES WITH THE LEGALLY ESTABLISHED MINIMUM TRAINING STANDARDS.
