This article examines recent developments in America's effort to reduce smoking among minors.
Abstract
In August 1996, President Clinton signed an executive order authorizing extensive Food and Drug Administration (FDA) regulations aimed at reducing smoking among minors. He ordered the FDA to: (1) prohibit sales of cigarettes and chewing tobacco to minors; (2) require merchants to see proof of age before selling tobacco: (3) prohibit vending machine sales of tobacco products; (4) ban billboard advertisements near schools and playgrounds; (5) limit tobacco advertising in periodicals read by children to text only; (6) ban tobacco companies from supplying promotional products that include tobacco product logos; (7) ban tobacco brand name sponsorship of sports or entertainment events; and (8) require the tobacco industry to fund a $150 million annual public education campaign to prevent youth smoking. In addition to these Federal Government initiatives, State and local governments have also proposed legislation intended to protect children from tobacco-related illnesses. The article describes some of the State initiatives, discusses children's exposure to second-hand smoke, and suggests new areas for tobacco litigation. Endnotes
