This looseleaf manual provides eight background articles, reports, and guidelines for use by tribal and Federal judges as reference material in connection with cases of child sexual abuse on American Indian reservations.
Abstract
The first report presents case statistics collected as part of a Federal-level child abuse and neglect mail survey administered to Indian Health Service unit directors and Bureau of Indian Affairs agency superintendents nationwide. The survey gathered information on the numbers and types of child abuse cases; the duration of abuse; victim and offender age, gender, and relationship; the role of alcohol or drug abuse. The report also provides an overview of issues related to treatment. The next articles review issues related to the question of who possesses jurisdiction over a perpetrator of a crime in Indian country and Federal laws regarding child sexual abuse. Further reports summarize Federal appellate court decisions regarding child sexual abuse, issues related to expert testimony in child sexual abuse prosecutions, and medicolegal considerations in the medical evaluation of child sexual abuse. The final articles present the Federal sentencing guidelines for child sexual abuse and an overview of the Federal victim-witness assistance program.
