SUGGESTION OF STANDARDS AND GUIDELINES FOR PLANNING, DEVELOPING, AND OPERATING AN EFFECTIVE CASEFLOW MANAGEMENT SYSTEM.
Abstract
THE MONOGRAPH PRIMARILY CONCERNS TRIAL COURTS OF GENERAL JURISDICTION. THE SUGGESTED STANDARDS ARE INTENDED TO APPLY EQUALLY TO ALL TRIAL COURTS, REGARDLESS OF SIZE OR TYPE OF JURISDICTION. IN COURTS WITH A VERY HIGH VOLUME OF SMALL CASES AND IN SPECIALIZED COURTS SUCH AS JUVENILE OR PROBATE, ADAPTATION OF THE STANDARDS IS REQUIRED BUT BASIC PRINCIPLES REMAIN APPLICABLE. TIMELY MOVEMENT OF ALL CASES IS STRESSED, NOT ONLY THOSE THAT ULTIMATELY GO TO TRIAL. THE GOAL IS TO ENSURE TIMELY DISPOSITION, REGARDLESS OF THE FORM OF THAT DISPOSITION. THIS PAPER IS NOT CONCERNED WITH POST-DISPOSITIONAL PHASES OF LITIGATION OR THE SUPERVISION OR ENFORCEMENT OF JUDGMENTS. APPENDED IS A SELECTED BIBLIOGRAPHY. (AUTHOR ABSTRACT)
