This is an overview of a book that compares various aspects of criminal justice in the Netherlands and England and Wales.
Abstract
The authors of the various chapters focus not only on the differences in the criminal justice systems but on any convergence that is occurring between the inquisitorial and the accusatorial regimes. Each chapter is written by at least two authors, each from a different jurisdiction. One chapter shows that in the Netherlands the prosecution has more discretion in the diversion of cases from prosecution than in England and Wales. Another chapter examines the various procedures for police interrogation. Other chapters are concerned with the ways in which the various criminal justice systems go about fact-finding. Some chapters address the Europeanization of criminal justice, i.e., the tendency of European countries to evolve toward similar criminal justice policies; prisoners' rights; the protection and compensation of victims; intergovernmental cooperation; and the transfer of prisoners.
