THE BUREAU OF PRISONS' POLICIES AND PROCEDURES IN REGARD TO THE HANDLING OF YOUTHFUL OFFENDERS, PARTICULARLY THOSE COMMITTED UNDER THE FEDERAL JUVENILE DELINQUENCY ACT, ARE DISCUSSED IN HEARINGS.
Abstract
THE HOUSE SUBCOMMITTEE ON COURTS, CIVIL LIBERTIES, AND THE ADMINISTRATION OF JUSTICE MET IN MADISON, WIS., TO DISCUSS THE BUREAU OF PRISONS' POLICIES AND PROCEDURES. ACTS RELATING TO INCARCERATION OF YOUTHFUL OFFENDERS INCLUDING THE FEDERAL JUVENILE DELINQUENCY ACT AND THE YOUTH CORRECTIONS ACT OF 1974, WHICH WERE PASSED IN AN ATTEMPT TO DIVERT YOUTH FROM THE DEBILITATING EFFECTS OF THE CRIMINAL JUSTICE SYSTEM BY REQUIRING PLACEMENT IN FOSTER HOMES OR COMMUNITY TREATMENT CENTERS, WERE FOCUSED UPON. WITNESSES INCLUDED THE DIRECTOR OF THE FEDERAL BUREAU OF PRISONS, A MEMBER OF THE YOUTH POLICY AND LAW CENTER, AND THREE ATTORNEYS, TWO OF WHOM ARE MEMBERS OF THE MENOMINEE LEGAL DEFENSE/OFFENSE COMMITTEE. THE DIRECTOR OF THE FEDERAL BUREAU OF PRISONS URGED REFORM OF THE CRIMINAL CODE, REPEAL OF THE YOUTH ACT, AND ENACTMENT OF A GENERAL EXPUNGEMENT PROVISION REGARDING CRIMINAL RECORDS INTO EXISTING LEGISLATION. CONTINUED COMMITMENT TO COMMUNITY-BASED CARE WAS EMPHASIZED BY SEVERAL WITNESSES, AND A REEVALUATION OF THE CONCEPT OF INDETERMINANT SENTENCING URGED. APPENDIXES INCLUDE TEXTS OF THE LAWS DISCUSSED, CORRESPONDENCE BETWEEN HEARING PARTICIPANTS, AND DESCRIPTIONS OF JUVENILE FACILITIES. (LWM)
