This most timely article explores the reach of the Supreme Court's decision in Neville, which allows the admission into evidence of a motorist's refusal to submit to a blood-alcohol test.
Abstract
The Court determined that this procedure did not offend the Fifth Amendment and thereby continued judicial support for the current crusade against drunk driving. The author goes beyond the boundaries of Neville and examines relevant state statutes and explores the key question of what is a refusal. This article is a most valuable contribution to the current legal literature on a timely and very 'hot' subject. ((Publisher abstract)
