THIS NOTE CONSIDERS THE EXTENT AND INTENSITY IN THE UNITED STATES OF CORRECTIONAL PROGRAMS USING ORGANIC CONDITIONING TECHNIQUES, THE LEGAL RAMIFICATIONS OF SUCH PROGRAMS, AND PROSPECTS FOR THE FUTURE.
Abstract
THE LEGAL PROTECTIONS AGAINST INVOLUNTARY INMATE TREATMENT IDENTIFIED AND DISCUSSED INCLUDE THE FIRST AMENDMENT RIGHT TO FREE EXPRESSION AND 'MENTAL INTEGRITY,' THE RIGHT TO (MENTAL) PRIVACY, DUE PROCESS AND THE FOURTEENTH AMENDMENT RIGHT TO EQUAL PROTECTION, AND THE EIGHTH AMENDMENT PROHIBITION AGAINST CRUEL AND UNUSUAL PUNISHMENT. ALSO COUNSIDERED ARE THE RELATED ISSUES OF THE MORALITY OF THE USE OF BEHAVIOR MODIFICATION AGAINST THE WILL OF THE INDIVIDUAL AND THE DANGER OF POTENTIAL ABUSE.
