SEVERAL FACTORS DETERMINE WHETHER THE PLAINTIFF OFFICER WILL BE AWARDED DAMAGES. CONSIDERED ARE WHETHER THE OFFICER WAS ON DUTY, IN UNIFORM OR OTHERWISE IDENTIFIED, ACTING WITHIN HIS STATUTORY AUTHORITY AND TERRITORIAL JURISDICTION, AND WHETHER THE OFFICER PROVOKED THE ACTIVITY WHICH LED TO THE ASSAULT.
